The Balearic Government fine with 24,000 euros to Ryanair for the collection of hand luggage

The General Directorate of Consumption of the Balearic Government has imposed a fine of 24.000 euros to Ryanair for the practice of collecting the hand luggage that passengers introduce in cabin.

As reported from Facua-Consumenores in Action and the Autonomous Executive, the Association denounced this practice in November 2019 before the 17 Autonomic Consumer Protection authorities.

Speaking to Europa Press, the general director of consumption of the Government, Félix Alonso, explained that the Balearic Executive has received up to 20 claims, together with Facua's, in relation to the airline's hand luggage policy.

"We are the first autonomous community that puts a sanction to Ryanair for the collection of hand luggage," said Alonso, who has assured that the Balearic Executive has based the filing of this fine in different sentences.

According to Facua, the Balearic administration considers that the inclusion of a clause that enables the collection of a surcharge for raising hand luggage to the cabin of the plane must be reported as "an abusive practice".

The Association has pointed out that several judicial sentences have spoken in the sense that hand packages are not considered luggage and that the carrier is obliged to carry them free of charge in the cabin.In the same way, he has referred to the Court of Justice of the European Union (TJUU) and the Air Navigation Law itself that are also pronounced on this issue.

Serious infraction to its maximum degree

For all these reasons, the General Directorate of Consumer.

According to Facua, the Balearic regulations contemplate fines of 4.500.01 euros at 24.000 euros for the case of serious infractions.By imposing the sanction to its maximum degree, consumption has finally decided to set the amount in 24.000 euros.

Ryanair can still file a contentious-administrative appeal in court against this resolution.
